Terms of Service

1. Agreement to Terms

By accessing or using the NoTemp.email API, website, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

NoTemp.email provides a real-time API for detecting disposable and temporary email addresses. The Service includes the API endpoints, the user dashboard, documentation, and any associated tools or features we make available.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 16 years of age to create an account and use the Service.

4. API Usage & Rate Limits

Your use of the API is subject to the rate limits and quotas associated with your plan. The free tier provides up to 100 API requests per month at no charge. Paid plans offer higher quotas and rate limits as described on the billing page. Exceeding your plan’s limits may result in throttled or rejected requests until your usage resets or you upgrade your plan.

API keys are personal and non-transferable. You must not share, sell, or redistribute your API keys. Automated systems generating or cycling through multiple free accounts to circumvent limits are prohibited.

5. Paid Plans & Billing

Paid plans are billed on a recurring basis (monthly or annually) via our payment processor, Lemon Squeezy. By subscribing to a paid plan, you authorize us to charge your payment method at the start of each billing cycle.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods unless required by applicable law.

6. Service Level Agreement

Paid plans are subject to our Service Level Agreement, which describes our uptime commitment and related terms. The free tier is provided on a best-effort basis without uptime guarantees.

7. Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including its design, code, database, and content, is owned by NoTemp.email and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Service or its underlying technology without our prior written consent.

9. Data & Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy. For enterprise customers, our Data Processing Addendum governs data processing on your behalf.

The email addresses you submit to the API for checking are processed transiently and are not stored beyond the duration of the request unless explicitly stated otherwise in your plan.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate.

While we strive to maintain an up-to-date database of disposable email providers, we cannot guarantee 100% detection accuracy. You acknowledge that the Service is one component of your overall email validation strategy.

11. Limitation of Liability

To the maximum extent permitted by law, NoTemp.email shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NoTemp.email, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend your access to the Service immediately if you materially breach these Terms, engage in prohibited conduct under the Acceptable Use Policy, or if required by law.

For other reasons, we may terminate your access with at least 30 days’ advance notice via email. You may terminate your account at any time by contacting us at support@notemp.email.

Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days unless retention is required by applicable law. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

14. Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, government actions, pandemics, labor disputes, Internet or telecommunications failures, cyberattacks, and failures of third-party infrastructure providers.

If a force majeure event continues for more than 60 days, either party may terminate the Agreement upon written notice.

15. API Versioning & Deprecation

We may update, modify, or deprecate API endpoints over time. When deprecating an endpoint or making breaking changes, we will:

• Provide at least 90 days’ advance notice via email and the Service dashboard
• Maintain the deprecated endpoint in a functional state during the notice period
• Provide migration guidance and documentation for updated endpoints

Non-breaking changes (e.g., adding new response fields) may be made without advance notice.

16. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Service.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv-Jaffa, Israel.
